TERMS AND CONDITIONS OF VEHICLE RENTAL
The Rental Provider (the “Lessor”) leases the vehicle to the Customer (the “Lessee”) subject to these Terms and Conditions (the “Contract”). By entering into this Contract, the Lessee acknowledges having read and understood its contents. Please read carefully and contact us before acceptance if you do not understand or agree with any provision.
1. Delivery and Return
The Lessor delivers the vehicle in good general and operating condition and free from apparent defects. The Lessee agrees to return it in the same condition, with all documents, parts and accessories, on the date and time specified in this Contract. Any alteration to the return terms must be authorized in advance by the Lessor. The Lessor may take possession of the vehicle at any time, without prior notice, if it is being used in breach of this Contract.
The Lessor reserves the right to cancel delivery if the Lessee has outstanding obligations or a history of serious incidents with the Lessor.
2. Use of the Vehicle
The Lessee agrees to use the vehicle in compliance with traffic and highway laws, to keep it in good condition, to keep it locked when not in use, to use the correct fuel, and to activate safety devices when necessary. It is expressly prohibited and shall constitute a breach of this Contract to:
(a) Sublease the vehicle.
(b) Transport goods for hire or reward.
(c) Push or tow any vehicle, trailer, or object.
(d) Participate in races, rallies, tests, or similar competitions.
(e) Drive under the influence of alcohol, drugs, or any substance that impairs consciousness or responsiveness.
(f) Commit any road safety offense.
(g) Permit driving by any person not authorized in this Contract; in such cases the Lessee remains responsible.
(h) Drive without meeting minimum requirements: age at least 23 years and holding a valid original driving licence for at least 2 years.
(i) Drive outside the Canary Islands.
(j) Travel between islands within the Canary archipelago without the Lessor’s prior written consent.
(k) Drive in restricted areas: airport runways, roads unsuitable for traffic (permitted roads are public roads, garages or parking spaces, and private roads not used for industrial or agricultural purposes); prohibited or dangerous areas (beaches, ravines, mountains, etc.), unpaved roads, or any routes that may deteriorate tyres or damage the underside.
(l) Transport animals (except guide dogs).
3. Fines, Penalties, Towing and Related Costs
All fines, penalties, towing charges, administrative expenses, vehicle standstill costs arising from traffic violations or breaches of laws, as well as damage to wheels/tyres and fuel costs, are the responsibility of the Lessee.
4. Rental Charges
The Lessee agrees to pay: the rental price per the applicable tariff and taxes; insurance (see Clause 5); late return charges (applicable from 59 minutes after the contractual return time); fuel consumed; refuelling; and any additional charges, including:
Airport delivery: €15
Loss of accessories and/or documents: €30
Delivery to private parking: applicable fee
Key replacement: €100
Incorrect refuelling: €150
Excessive dirt cleaning fee: €50
Battery drain due to lights left on: €60
The Lessor may require one or two credit cards to cover the excess deposit and/or fuel guarantee.
5. Insurance
Coverage:
Insurance covers the Lessee and authorized drivers for third-party liability (CDW), deposit, and legal defense as required, provided the driver complies with this Contract. The Lessee’s liability is limited as follows:
(I) If the Lessee accepts the Collision Damage Waiver (CDW) in the Contract, liability for loss of or damage to the vehicle, parts, accessories, theft, and fire is limited to the applicable excess:
Groups B, C, D, E, E1: €300
Groups F, G, H, I, J, I1, J1, K, L: €450
(II) If the Lessee accepts Super CDW / TP in the Contract, the excess may be reduced to zero for an additional daily charge:
€3/day for Groups B, C, D, E, E1
€6/day for Groups F, G, H, I, J, I1, J1, K, L
or as per the current rate excluding excess.
Exclusions:
Insurance does not cover: punctures; tyre damage; rim covers; rims; underside; interior parts; upholstery; clutch; loss or breakage of keys, accessories, or documentation; towing costs; traffic fines; damage caused by negligence, reckless driving, driving under the influence of alcohol and/or drugs; driving on dangerous or unpaved roads; incorrect refuelling and battery damage from misuse.
Loss, theft, or damage to goods carried in the vehicle are expressly excluded and remain the sole responsibility of the Lessee.
6. Accidents
In the event of an accident, the Lessee must:
(a) Immediately report any accident, loss, damage, or theft to the Lessor and to the police.
(b) Not admit or prejudge liability.
(c) Obtain full details from the other party and promptly forward them to the Lessor. The Lessee must cooperate with the Lessor and its insurer in any investigation or legal proceedings. Failure to do so will void any accepted and paid coverage.
7. Repairs
The Lessor will bear expenses during the hire for lubrication, oil, water, and minor repairs (excluding punctures) up to €10, subject to presentation of receipts/invoices. Prior authorization from the Lessor is required for any repair or towing of the vehicle.
8. Our Responsibility
The Lessor has taken necessary precautions to prevent mechanical failure. If failure occurs, the Lessor is responsible for damages suffered by the Lessee in the event of death or personal injury as required by law. The Lessor assumes no responsibility for any other damages directly or indirectly suffered by the Lessee as a result of failure or accidental damage.
9. Conditions
Minimum driver age: 23 years. Original driving licence held for at least 2 years.
Unlimited mileage.
Second driver at no extra charge.
Airport delivery: minimum 3-day rental.
10. Child Restraint Systems
Upon request, the Lessor provides baby seats, booster seats, and other approved equipment. Staff are not permitted to install these systems; the Lessee is exclusively responsible for correct installation, securement, and ensuring suitability for the child’s age. The Lessor is exempt from liability for any damage and/or injury arising from use of such systems.
11. Privacy Policy
In accordance with Law 15/1999 of 13 December on Personal Data Protection, personal data provided by the Lessee will be processed and included in files for the purpose of carrying out automated activities related to the Lessor’s business. The Lessor guarantees confidentiality and proper use of information and will adopt necessary technical and organizational security measures.
12. Governing Law and Jurisdiction
The parties intend to resolve disputes amicably. Any discrepancy or conflict between Lessor and Lessee shall be submitted to the jurisdiction of the competent courts in the Canary Islands, applying Spanish law, with express waiver of any other jurisdiction.
