Terms and Conditions of Teneprime Services

§1 General Provisions

  1. These Terms and Conditions define the rules for the provision of services by: Radosław Leszek Opała

  2. CL JOSE MIGUEL GALVAN BELLO 44, 38612 MEDANO (ST CRUZ DE TENERIFE), ESPAÑA, NIF: Z1361564S, hereinafter referred to as the "Service Provider".

  3. Using the Teneprime website and services is equivalent to accepting these Terms and Conditions.

  4. The Terms and Conditions are valid indefinitely.

§2 Definitions

  1. Client – a person using the services of Teneprime.

  2. Booking form – a form used to check the availability of a selected service or equipment, specifying the date and time of delivery and return.

  3. Booking cancellation – failure by the Client to collect the equipment / use the service, or a cancellation made by the Client via the cancellation form available on the Teneprime website.

§3 Services

A. Short-term property rental

  1. The Client selects an apartment, checks availability, and makes a booking by paying a non-refundable reservation fee online, amounting to 15% of the total booking value.

  2. The reservation fee is non-refundable up to the amount of €100. If the reservation fee amount (15%) is less than €100, the entire fee is forfeit in the event of cancellation or the Client's no-show. If the reservation fee exceeds €100, in the event of cancellation or no-show, the equivalent of €100 is forfeit, and the surplus above this amount is refunded to the Client.

  3. The remaining balance is payable in cash on the day of key collection or the following day.

  4. The cleaning fee is included in the booking form.

B. Scooter rental (125 cc)

  1. The Client must hold a valid driving license of the appropriate category.

  2. The reservation fee of 20% of the booking value is non-refundable up to the amount of €50.

  3. If the reservation fee amount (20%) is less than €50, the entire fee is forfeit in the event of cancellation or the Client's no-show.

  4. If the reservation fee exceeds €50, in the event of cancellation or no-show, the equivalent of €50 is forfeit, and the surplus above this amount is refunded to the Client.

  5. For rentals of at least 3 days, the delivery and collection of the scooter are free of charge. For shorter bookings, a one-time fee of €20 applies, covering both delivery and collection.

  6. The scooter is delivered with two helmets and a full tank of fuel, and must be returned in the same condition.

  7. The Client shall incur a fee of €50 for damage to the equipment resulting from improper or unskillful use.

C. Sports equipment rental (paddleboards, kayaks, bicycles)

  1. At the time of booking, a reservation fee of 20% of the booking value is charged, which is non-refundable up to the amount of €25.

  2. If the reservation fee amount (20%) is less than €25, the entire fee is forfeit in the event of cancellation or the Client's no-show.

  3. If the reservation fee exceeds €25, in the event of cancellation or no-show, the equivalent of €25 is forfeit, and the surplus above this amount is refunded to the Client.

  4. The equipment is provided with appropriate safety gear (life jackets, helmets, protective bags).

  5. For a 1-day rental, an additional fee of €20 applies for the delivery and collection of the equipment. For rentals of 2 days or more, delivery and collection are free of charge.

  6. The Client shall incur a fee of €50 for damage to the equipment resulting from improper or unskillful use.

D. Sightseeing tours in Tenerife

  1. Pursuant to Art. 16(l) of Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on consumer rights, in the case of booking tours scheduled for a specific date, the Consumer is not entitled to the statutory right to withdraw from the contract within 14 days.

  2. The condition for booking is the payment of a non-refundable reservation fee amounting to 10% of the total tour price.

  3. In the event of a cancellation reported by the Client more than 7 days (over 168 hours) before the scheduled start time of the tour, the Service Provider shall refund 100% of the paid amount minus the non-refundable reservation fee amounting to 10% of the tour price.

  4. In the event of a cancellation reported less than 7 days (168 hours or less) before the scheduled start of the tour, or in the event of a no-show at the meeting point (No-Show), the Client is not entitled to a refund of any funds due to operational costs and the inability to resell the spot.

  5. In the event of the tour being canceled by the Service Provider (e.g., due to force majeure, extreme weather conditions), the Client is entitled to a 100% refund of the paid funds or the option to change the date.

E. Other tourist attractions (paragliding flights, cruises, picnics)

  1. The Client fills out the booking form. The Service Provider confirms availability within 24 hours.

  2. After confirmation, the Client makes an online payment.

  3. Booking cancellation results in the forfeiture of a €25 reservation fee; the remaining amount is refunded to the Client.

  4. After making the booking, the Client receives an online voucher with the date and time, entitling them to use the service.

F. Car rental

  1. Teneprime acts as an intermediary in car rentals without a deposit in cooperation with partner companies.

  2. Availability and prices are listed on the website. Confirmation of availability takes place up to 12 hours after submitting the booking form.

  3. Upon confirmation of availability, a non-refundable reservation fee of 20% of the booking value is collected to secure the booking.

§4 Complaints

  1. Complaints are processed within 21 days from the date of submission via the complaint form available on the Teneprime website.

§5 Liability

  1. The Service Provider is not liable for fortuitous events or actions of third parties causing loss of health or life to the Client associated with the use of the rented services or equipment.

§6 Final Provisions

  1. Disputes shall be resolved in accordance with Spanish law, before the court competent for the location of the Service Provider.
